Negotiation Skills for Lawyers
Lawyers need to know how to negotiate
They might be agreeing terms of an acquisition/sale agreement
or legal points in Standard Form Documentation. They might
be bargaining over terms when negotiating commercial contracts.
Lawyers acting in litigation and disputes have to negotiate
out of conflict towards settlement. These are just some examples.
Negotiations conducted by in-house or private practice lawyers
may take the form of letter, email, telephone calls or meetings.
In solicitor-to-solicitor negotiations there is an added dimension
of the solicitor/client relationship. The solicitor has to
exert influence in that relationship. Unlike other negotiations
between parties directly involved, the lawyer is often engaged
in negotiation by proxy.
How to negotiate
To negotiate effectively lawyers need a clear approach, a
real understanding of precisely what negotiation is and some
insight into their particular negotiating style.

in the heat of the negotiations
